The legalization of cannabis for industrial use dated back to December 2018 and was implemented on January 1, 2019. This development follows more than 80 years of hemp banishment in America.

About cannabis in the US

The prohibition of cannabis on American soil dates back to the Marijuana Act, implemented in 1937. The NASDA request

The NASDA, an association that brings together all the agricultural departments of the various American states, has indeed come out in favor of an increase in the legal limit of THC present in legal cannabis from 0.3 to 1%. This position is also defended by the Hemp Industries Association, which brings together players in the hemp sector.

The objective of this demand is to offer more flexibility to producers of legal cannabis to respond more quickly to the market’s needs. In addition, this increase in the threshold responds to the needs of growers who produce legal cannabis intended to be transformed into a CBD product.

Benefiting from more tolerance on the allowable THC level would give more choice in the varieties of cannabis cultivated.

It would also facilitate the implementation of cultural practices to optimize the level of CBD in the plant without risking exceeding the authorized concentration of THC.

NASDA advice is indicative only. The association does not have the power to modify the laws in force in the USA. However, it stresses that such a change in the legislation could only be favorable to the hemp sector in the USA and promote the prosperity of an industry in full development and with promising prospects. In a country known for its liberalism, let’s hope that such an initiative will see the light of day.

Especially since the USA is not the only one to authorize or consider a maximum THC level of 0.2 to 0.3%, Switzerland is thus one of the countries where the top level of THC authorized in hemp is 1%. Similarly, negotiations are also currently taking place in Europe to increase the maximum legal limit of THC allowed in legal cannabis. Case to follow!

United States to legalize 1% THC hemp

The departments specialized in managing agricultural policies of the various American states grouped within the NASDA association ask for an increase in the maximum level of THC authorized in hemp from 0.3 to 1%.

2018: CBD from hemp receives federal legalization

With the Hemp Farming Act in December 2018, the whole deal about CBD has changed.

The bill makes hemp an agricultural product and removes it from the list of controlled substances, removing it from DEA oversight.

In other words, any industrial hemp product is now federally legal nationwide, including CBD.
