Not every marriage is a peaceful one. If you and your spouse intend to separate, and there is no hope of reconciliation, divorce is probably the only option left. Divorce is more than just a legal process. It will eventually impact your life, social, and financial standing. Getting a divorce in South Carolina doesn’t have to be complicated, especially when both spouses want the same. It is possible to obtain a no-fault divorce in SC. Below are some pointers worth knowing.

The Basic Aspects

If you and your spouse have been living apart for more than a year, you can file for a no-fault divorce, where you don’t blame your spouse for anything. There are also fault-based grounds for a divorce, including adultery, willful desertion, physical cruelty, and habitual drunkenness. As in other states, you must fulfill a few residency requirements to get a divorce in SC. Either of the spouses must have lived in South Carolina for at least one year. In a no-fault divorce, you must have stayed apart from your spouse continuously for one entire year. If you have marital assets, the court will equitably divide the same.

Divorces are complicated. While South Carolina allows for a simple divorce, separated and estranged spouses do not often agree to the basic aspects. If you can come to an agreement with your spouse concerning child support, child custody, and alimony, you can ease the process considerably. Hiring a divorce lawyer is about having expertise and experience on your side. They know the local courts and state laws, and no matter the circumstances, they will work to protect your rights and interests. You can expect the attorney to deal with the complicated paperwork at every step.  

How Much Do Divorce Lawyers Charge in South Carolina?

It depends. Some attorneys work on an hourly rate, but if there is no way to determine an estimate, they can charge a flat or retainer fee. If your divorce doesn’t involve too many battles and complications, you can expect an attorney to charge a flat fee. Ask the lawyer if there are other expenses of the case to know the actual cost of the divorce. 

Final Word

Legal counsel and advice matter over everything else in a divorce. If your lawyer is talking to your spouse and their lawyer, the chances of reaching an acceptable separation agreement are much higher.
