No matter how experienced a driver you are or how well you are behind the wheel, sometimes, someone else being negligent on the road can drag you into a car crash. Despite strict laws, various factors contribute to a car accident. It is often due to distracted driving, DUI, violation of traffic laws, poor road conditions, and more. The burden of paying medical bills after getting injured in a car collision can toll the victim.

The victim needs to call the police immediately after being injured in a car accident in Queens. Even if there is a minor accident, it is the victim’s responsibility to inform the police and file a report. However, various unfortunate events can lead to the victim being unable to notify the police. For example, the victim may have been seriously injured and rushed to the nearest hospital. It gets challenging to inform the police and let them file an official report in such cases.

Many victims are confused if they can file for a car accident claim without a police report. Since the rules may vary from time to time, it would be in your best interest to contact a car accident attorney and let them assist you.

Is a Police Report Important for a Car Accident Claim?

After getting into a car accident, you must inform the police. Often, the police will arrive soon to the accident scene. Based on the circumstances and visible evidence, the police will file a report that will have all the basic yet significant information about the incident. Note that if the accident is not significant or no one is injured, the cops may take a while to arrive or not arrive at all.

Some of the information that the police report contains include:

  • Exact date and time of the accident.
  • Physical injuries the victim(s) have incurred.
  • Damage to property (car).
  • Weather conditions.
  • Surroundings of the accident scene.
  • Who is liable for the accident.

If the police do not arrive at the accident scene, you can file a report by visiting the nearest police station. Remember, give all the details about the accident scene to the police. After the police file a report, ensure to get a copy of the same.

What happens if you do not have a Police Report?

Although a police report contains crucial information about the accident scene, it is worth noting that the insurance company cannot use the police report alone to decide who is liable for the accident. You CAN file for a car accident claim without a police report. However, having a copy of the report supports your car accident claim and strengthens your case.

However, if you do not have a police report, you can file a claim. The insurance company will conduct its investigation to decide who is to blame for the accident.
